PLANNING PERMISSION: Planning permission reference number 3PL/2007/0096/F was granted by Breckland District Council on the 19th April 2007. The conditions of the planning permission are set out below:

1. The development must be begun not later than the expiration of THREE YEARS beginning with the date of this permission. Reason for condition:- As required by section 91 of the Town & Country Planning Act 1990 (as amended).

2. The development must be carried out in strict accordance with the application form, plans, drawings and other documents and details submitted or provided by the applicant, as amended by the documents referred to above. Reason for condition:- To ensure the satisfactory development of the site.

4. Prior to the first occupation of the dwelling hereby approved the proposed drive shall be constructed using the construction method/details as indicated on the approved plans. Reason for condition:- In the interests of the amenities of the area.

5. The development must be carried out in strict accordance with the application form, plans, drawings and other documents and details submitted or provided by the applicant, as amended by the documents referred to above. Reason for condition:- To ensure the satisfactory development of the site.

6. The occupation of the dwelling hereby approved shall be limited to a person solely or mainly employed in connection with the adjoining nursery, or a dependant of such a person residing with him or her, or a widow or widower of such a person and to any residential dependants. Reason for condition:- The Local Planning Authority’s policy for this rural area is to resist the erection of dwellings which are not essential to the needs of local agriculture.

7. Prior to the occupation of the dwelling hereby approved, the existing mobile home shall be removed from the site. Reason for condition:- In the interests of a satisfactory appearance of the development.

8. Prior to the first occupation of the dwelling hereby permitted sufficient space shall be provided within the site to enable vehicles to turn and re-enter the highway in a forward gear. This area shall be levelled, surfaced and drained to the satisfaction of the Local Planning Authority in consultation with the Highway Authority and thereafter retained free from any impediment to that specific use. Reason for condition:- In the interests of satisfactory development and highway safety.

9. NOTE - This permission is subject to a S.106 agreement revoking outline permission 3PL/2005/0222/O.

NOTE - This decision to grant planning permission has been taken having regard to the policies and proposals set out in the Breckland District Local Plan adopted September 1999 summarised below and to all relevant material considerations, including Supplementary Planning Guidance: HOU.6 Residential development will not be permitted outside of Settlement Boundaries unless it is justified for agriculture, forestry, recreation, tourism or the expansion of existing facilities.

On the 19th April 2007 a section 106 agreement was agreed between Breckland District Council and the vendor thus enabling the erection of the property in connection with the horticultural nursery.

GENERAL: This is an ideal situation for somebody to develop this business, build a large four bedroom detached house.
